1st Park.com End User Agreement
Terms and conditions of use at this facility, location, site, car park, public highway, private, commercial,or local authority owned property.
By parking your vehicle i.e. Car, Van, Motorcycle, Coach, HGV, or other powered and or motor assisted vehicle other than a horse drawn carriage at the above location types or other types not defined as above. You will be deemed to of agreed to the terms and condition set out in this agreement displayed on the 1stPark.com Ltd web site or displayed at the facility that you have parked your vehicle. If your vehicle is on any premises or land owned or serviced by 1st Park.com Ltd you will be deemed be aware of and to have agreed to the terms mentioned here. Phone customers please check these terms and conditions.
Should the agreement not be visible or available at your facility where you have parked your car, then the terms and conditions on this website will apply and be enforced where applicable and no exception to the terms and conditions will be entered in to. All Vehicles are parked or left at the owner's own risk.
1stPark.com Ltd will not be held responsible for any loss of property due to neglect or to theft while you or your vehicle is using the facility or any premises or property that is represented or owned by 1stPark.com Ltd Nor will 1stPark.com be held responsible for any subsequent losses financial or other due to your vehicle being immobilised clamped, towed away or uplifted on to a carrier vehicle. 1stPark.com Ltd will not be responsible or held liable for any injury or death that may occur while you or your passengers or members of your party are using any facility. Caution must be used when using the (any) facility as it is a car park and not a PLAY GROUND if you have young children with you keep them with you at all times also be vigilant for small children running out from between parked cars. We will not accept any responsibility for any vehicle that is on property represented or owned by 1stPark.com and we will not accept any responsibility for any claim of damage that may have been alleged to of occurred while your vehicle is in transit to the reclaim depot.
- On arrival at an available space you the customer must telephone the advertised number at the location. We can not be held responsible for any alteration made by acts of vandalism or mallituos 3rd parties acts the correct number is displayed on this web site.
- Any misdailed numbers or errors in connection will be charged for and are not refundable by 1stPark.com Ltd. Please dial carefully. Please make sure you have the full permission of the bill payer. Vehicles left at any location and claim that they where stolen and abandoned at the site will incur all charges unless fully supported by the police and insurance company documentation this will be at the company's discretion and not a right to any form of refund either in full or part.
New users should register either on line or on the phone using their mobile phone and have a valid form of payment card i.e. Debit or a credit card. When using our facility YOU the customer will incur a booking fee on your credit card. Currently we will charge a flat rate of £0.80 per transaction. We reserve the right to review this at any time this rate may go up or down without notice to you the customer. (CUSTOMER TIP IF YOU WERE TO USE OUR FACILITY EVERY DAY CALCULATE YOUR WEEKLY SPEND AND CHARGE THAT AMOUNT TO YOUR ACCOUNT AT 1stPARK.COM LTD. FOR EXAMPLE £2 PER DAY, 5 DAYS A WEEK IS £10.00 SIMILAR TO TOPPING UP YOUR MOBILE, PUT £11 ON ACCOUNT YOU THEN WOULD HAVE £10 OF PARKING ON YOUR ACCOUNT. IF YOU PAID DAILY BY YOUR CREDIT OR DEBIT CARD THIS WOULD ATTRACT A £0.80p PER DAY BOOKING FEE.)
Any un-used Credit May be refunded However an administration charge may be applied this may be more than the outstanding credit that is being requested.
People who do not have a debit or credit card can still use the facility by applying for a non status debit card coming soon, or making a pre payment at you local branch, of your bank in advance of using the facility. This is a payment into the 1stPark.com Ltd account. However they must have registered on line to get your unique user identification card first.
- Calls to the car park call centre are charged at the national rate where ever you are in the county. YOU are responsible for this call charge.
- The call should take less than 1 minute if you are an experienced or existing user however if you are using the system for the first time it may take a little longer The details you provide either on this web site or over the phone will remain the property of 1st park.com and may be used for marketing purposes unless you express that you do not wish your details to be used in this manor. Your details can be updated on our web site and if you wish to be removed from any marketing promotion this can be done with a click of a button that says. I would like to be removed from any current marketing promotions.
- Once you have got through to the call centre you will be asked a series of questions the first will probably be if you are a registered user using the system with the mobile phone previously registered with us press 1. The following options are if you would like to park for up to 30 mins press 0, if you would like to park for -1hour press 1. If you wish to park for 1hour-2 opt 2. If you would wish to park for 2-3 hours opt 3. If you wish to park for 3-4hours press 4 if you would wish to park for 4-5 hours opt 5 & for 5-6 or opt 6 for all day. You will then be charged accordingly. Please note if you overstay your agreed time limit. A Premium rate text could be sent to your phone advising you that you have overstayed your agreed time and notifying you of what action has been taken i.e. fixed penalty, wheel clamp or removal of your vehicle. The cost of this text is an expense that is charged to you and is not refundable. You will find a contact number to recover your vehicle within the text message. The cost of the call to the wheel clamp, Compound or payment centre is at your expense and is not refundable. If your vehicle is at the compound you must make your own way to the compound at your own expense. Our or Our agents removal vehicles are not insured to carry 3rd party passengers
- In the event you are wheel clamped you must pay by a valid credit card or debit card on the payment line. A 3rd party may make this payment if you do not have a credit card or debit card. This arrangement is made between the 3rd party and you. We will not refund any payments or be liable for any 3rd party disputes. If after 1hour elapses and the wheel clamp has not been paid for removal we will exercise the right to uplift or tow away your vehicle. Once the tow truck men arrive and have physically alighted from their vehicle they must proceed to remove your vehicle until instructed to stop by the payment authorisation centre. Once they have alighted from their vehicle the tow or uplifting charge will be enforceable. This charge will also have to be paid by you.
- Disabled drivers please note that you must register for the discounted parking facility, and must only use the clearly identified parking bays to get the discounted or extended time if applicable. If you choose to go over the time allowed in the disabled space you will be treated the same as anyone else in the terms and conditions above. Although we sympathise with you and your condition we will not tolerate any misuse. Someone with the same or worse condition than you may wish to use that space. In the event that no clearly identified disabled parking bay are available at the time you wish to park you can of course use one of the full paying bays your discounted privileged pass may not be valid in these spaces. These are charged at the full rate and not refundable and no rebate will be applicable.
- Complementary parking can be done by arrangement. I.e. some local authority workers, Residential Permits, Home helps could park free of charge at permitted venues and sites. This arrangement would require further registration however the phone call to the payment centre on arrival would be chargeable at national rate usually 10p per minute subject to mobile providers terms and conditions.
- PLEASE NOTE THAT IF YOU ARE GRANTED A PRIVILEGED PARKING PASS OR A DISABLED PARKING PASS YOU MUST REGISTER ON ARRIVAL AS THE SYSTEM WILL NOT BE ABLE TO DIFFERENTIATE BETWEEN YOU AND A NON PRIVILEGED USER. ANY PERSON NOT FOLLOWING AND COMPLYING WITH THESE PROCEDURE'S WILL INCUR ALL RELATIVE CHARGES. THERE WILL BE NO EXCEPTIONS UNDER ANY CIRCUMSTANCE THERE IS A ZERO TOLERANCE POLICY IN FORCE 24/7
- All users please note at the time of writing meter feeding may be prohibited in your area although it has been discussed in the industry that the offence be abolished in certain areas it is your responsibility to gain suitable knowledge as to whether this applies to you in the area you area parked. If you can top up the system may let you however if you can not you must remove your vehicle on time or before you reach your maximum parking allowance at that location.
